A RESOLUTION OF THE CRAWFORD COUNTY BOARD OF COMMISSIONERS TO APPOINT A RECREATION BOARD FOR THE PURPOSE OF ESTABLISHING SUPERVISED RECREATION PROGRAM FOR CRAWFORD COUNTY, GEORGIA; TO PROVIDE FOR THE TERMS OF THE MEMBERS, DUTIES OF THE MEMBERS OF SAID BOARD, AND FOR OTHER PURPOSES.
WHEREAS, the Board of Commissioners has considered the establishment of a Recreation Board for the implementation of a County Recreation Program for citizens of Crawford County; and
WHEREAS, the Board of Commissioners has determined that it is in the best interest of the youth and all citizens of the County to appoint members to a Board of Recreation for such supervised County recreation program;
NOW, THEREFORE, BE IT RESOLVED, pursuant to Official Code of Georgia Sec. 36-64-1, et. seq. and by authority of same, there is hereby created the CRAWFORD COUNTY RECREATION BOARD, which shall consist of the following members and possess the following powers and exercise the duties as stated in this Resolution, as follows:
1. THE CRAWFORD COUNTY RECREATION BOARD
There is hereby created the "CRAWFORD COUNTY RECREATION BOARD" for the purpose of organizing and operating a supervised recreation program for the citizens of Crawford County.
Z. COMPOSITION, APPOINTMENT, AND TENURE
(a) The Recreation Board shall consist of seven (7) members appointed by majority vote of the Board of Commissioners. Except for the initial appointments of said members as stated herein, the term of each member shall be for three (3) years, or until a successor is appointed and qualified. Members appointed to the Board shall be residents of Crawford County. Any member who ceases to be a full-time resident of Crawford County during his term of office shall be deemed removed from office, and the Board of Commissioners shall appoint a successor for the unexpired term by majority vote.
Prior to any appointment of the Recreation Board, the county shall advertise seeking applicants. Applications will be available at the Administration offices of the Board of Commissioners. All perspective applicants will be required to submit to background checks.
(b) The term(s) of the members initially appointed herein shall be as follows:

(c) Members shall not be subject to limitations of terms and are eligible to succeed themselves through reappointment. Regular terms of office shall expire January 1 of each year, but members shall serve until their successors are appointed.
Vacancies on the Board, due to resignation, removal, death of a member, expiration of the term of office, or for any other reason, shall be filled by a majority vote of the Board of Commissioners. Appointments to fill any vacancy, except for vacancies due to the expiration of the term of office, shall only be for the unexpired term of the vacant office.
Board members may be removed at any time, with or without cause, by a majority vote of the Board of Commissioners.
The members of the Recreation Board shall serve without compensation.
5. OFFICERS AND RULES OF PROCEDURE
Immediately upon initial appointment, the members of the Recreation Board shall meet for the purpose of organizing itself. In addition, the Board shall elect one of its members as president, one of its members as treasurer, and elect such other officers as may be necessary for the proper functioning of the Board. The Board shall adopt appropriate rules, regulations, and by-laws to govern its proceedings and keep a correct record thereof. These rules, regulations, and by-laws may be amended from time to time by the then existing Recreation Board pursuant to such applicable rules of procedure. The County shall be furnished with a copy of the rules, regulations, and by-laws of the Board along with any amendments thereto.
Board meetings shall be on a monthly basis unless determined otherwise by the Board. The President of the Board may call a special meeting of the Board at any time by giving each member 24 hours notice. Special meetings will be open, subject to open records and scheduled upon request by five or more members. A quorum of the Board shall be in attendance before action of an official nature can be taken. A quorum is at least one (1) more than the number absent, of the appointed members.
The Board of Commissioners will not consider a gathering of a quorum of the Recreation Board Members at a sporting event as a violation of the open meeting act. However any Called or Special meeting must be advertised and open to the public. Same rules of procedure with respect to open meetings for the Board of Commissioners shall apply.
7. POWERS AND DUTIES
The Recreation Board shall establish, conduct, and maintain a system of supervised recreation for the County in such a way as to employ the leisure of the people in a wholesome and constructive manner. In particular, it shall possess the following responsibilities:
(a) To provide for, conduct, and supervise public playgrounds, indoor and/or outdoor recreation centers, concessions, and other recreational facilities owned or controlled by the County;
(b) To recommend the setting aside, leasing, or acquisition of lands or buildings within or without the County for use as parks, playgrounds, recreation centers, or for other recreational purposes, and to provide for the maintenance and improvements of such areas;
(c) To establish, conduct, and maintain a supervised recreation program;
(d) To submit a budget request annually to the County Commission for approval;
(e) To submit an annual report to the County Commission, which shall include a financial statement of money received and expended and a description of all activities sponsored by the Board during the year;
(f) To serve as an advisory board to the Commissioners regarding the needs of the community regarding recreation programs, facilities, and activities;
(g) To review and recommend enactment of policies and rules for the operation of the Recreation System;
(h) To monitor and evaluate the effectiveness of the recreation programs;
(i) To recommend a system or fees and charges for use of parks and recreation facilities or for participation in recreation programs.
(j) To adjudicate complaints, disputes, or other grievances from the public arising out of parks and recreation activities;
(k) To exercise such other powers and duties as may be delegated to it from time to time by the Board of Commissioners and as permitted by laws; and
(I) All actions of the Recreation Board are subject to review and approval by the Board of Commissioners at their discretion.
8. BUDGET, FUNDING, GIFTS AND GRANTS
(a) There is hereby created the Crawford County Recreation Trust Fund into which all funds received by or on behalf of the Recreation Department shall be deposited. These funds shall, unless specifically earmarked by the donor thereof, be used first for the operation of the recreation department budget. Any funds received in excess of the annual budget may be used as directed by the Recreational Board with Board of Commissioner approval.
(b) All requests by the Board for funds shall be submitted to the County in the form of an appropriate annual budget request, and any funds authorized by the County Commissioners shall be expended by the Recreation Board within the sole authority, discretion and control of the Board of Commissioners.
(c) The Board shall have the authority to accept gifts, grants, or bequests of real or personal property, or any donation thereof, which shall be used solely for recreational purposes. However, if the acceptance of any such gift or grant will subject the County to additional expenses for improvements or maintenance, the acceptance of such gift or grant of real or personal property shall be subject to the approval of the County Commissioners. Any donations of real or personal property shall be to and in the name of the County.
(d) Donations of money received from any source, unless otherwise provided by the terms of the gift or donation shall be deposited in the County treasury, in a separate account referred to as the Crawford County Recreation Trust Fund and shall only be withdrawn and paid out by such body in the same manner as funds appropriated for official recreation purposes.
